These Terms & Conditions (“Terms”) govern your use of our website and services, including creating an account, booking tickets for courses/events, and subscribing to our newsletter (together, the “Services”). By using the Services, you agree to these Terms.
1) Definitions

“We / Us / Our”: (David) Paul Chaney, the organizer of all Events sold on this website.

“You”: the user/customer booking Tickets.

“Event”: any course, workshop, class, or event offered by us.

“Ticket”: a booking confirmation granting the right to attend a specific Event (date/time/location).

“Consumer”: a natural person acting for purposes outside their trade/business (where applicable).
2) About our Services
We sell Tickets for Events organized and delivered by us. Event details (date, time, location, language, requirements) are shown on the Event page and form part of the contract.
3) Eligibility
You must be at least 18 to create an account and book, unless a parent/guardian completes the booking and accepts these Terms. Some Events may have additional age limits.
4) Booking, contract formation, and confirmation

Order process: When you place a booking, you submit an offer to purchase a Ticket.

Contract formed: A binding contract exists once we send your booking confirmation (by email).

Availability / errors: We may refuse or cancel bookings in case of availability issues, obvious pricing mistakes, or suspected fraud. If we cancel, we’ll refund amounts paid for the cancelled booking.
5) Prices and payment

Prices: Prices are shown at checkout in CZK and include all mandatory taxes/fees unless stated otherwise.

Payment provider: Payments are processed via [provider(s)]. You may also need to accept their terms.

Receipts: You receive a confirmation/receipt by email.
6) Tickets and entry

Ticket format: Tickets are provided electronically (by email).

Valid use: Tickets are valid only for the named Event and specified date/time/location.

Identity checks: We may request ID to verify the attendee, where reasonable.

Late arrival: Late arrival may mean you cannot join without disrupting the Event; in such cases, no refund is due (unless required by law).
7) Cancellation and refund policy
7.1 Customer cancellation
Full refund up to 14 days before the Event start time, minus a 10% administration fee.
Less than 14 days before the Event start time: non-refundable.
To cancel, use your account (if available) or contact [support email] with your booking reference.
7.2 Refund method and timing
Refunds are issued to the original payment method
Processing time is typically within 21 business days, depending on the payment provider/bank.
7.3 Exceptions
If we cancel the Event (Section 9), you are entitled to a full refund (no 10% fee).
If mandatory consumer law grants you stronger rights in your country, those rights are not affected.
8) Changes, cancellation by us, weather, and safety conditions
8.1 Event changes
We may make minor changes (e.g., exact route/spot outdoors, order of activities, tool selection) without liability.
8.2 Material changes
If we make a significant change (e.g., date/time change, major location change, major content change), we will inform you and offer either an alternative date/Event (if available), or a full refund.
8.3 Outdoor conditions
Events may be affected by weather and environmental conditions. We may adjust the program, pause, relocate within the area, or reschedule for safety.
8.4 Cancellation for safety/force majeure
If an Event is cancelled due to circumstances beyond our reasonable control (e.g., severe weather warnings, natural events, public authority restrictions), we will offer rescheduling or credit; refunds will be handled in line with mandatory law and what is feasible given the circumstances.
9) Outdoor workshops, hand tools, and safety rules (important)
Our Events are practical outdoor workshops that may involve physical activity and the use of hand tools. By booking and attending, you acknowledge and agree to the following:

Inherent risks: Outdoor workshops and hand tools involve inherent risks, including (without limitation) cuts, punctures, splinters, blisters, bruises, strains/sprains, allergic reactions (e.g., plants/insects), and injury caused by uneven terrain or weather conditions. You agree to take reasonable care for your own safety and the safety of others.

Mandatory safety instructions: You must follow all safety briefings, tool-handling instructions, and reasonable directions from the instructor at all times. You may only use tools in the manner demonstrated and may not improvise or use tools for unintended purposes.

Protective equipment and clothing: You are responsible for arriving with suitable clothing and footwear for outdoor conditions. We may require protective equipment (e.g., gloves, eye protection) depending on the activity. If you do not have the required equipment, we may (at our discretion) provide it, offer it for purchase/rent, or refuse participation for safety reasons.

Fitness and medical suitability: You are responsible for ensuring you are physically and medically fit to participate. If you have a condition that may affect safe participation (e.g., significant injury, reduced mobility, fainting risk, severe allergies, pregnancy, or any limitation affecting grip/coordination), you must notify us in advance and follow any reasonable safety adjustments we propose. We may refuse participation where we reasonably believe participation would be unsafe.

No impairment: You must not attend under the influence of alcohol, drugs, or any medication that impairs judgment, coordination, or reaction time. We may refuse entry or remove you if we reasonably suspect impairment.

Safe behavior and supervision: Reckless behavior, horseplay, harassment, refusal to follow instructions, or unsafe tool handling is strictly prohibited. We may stop the activity or remove any participant to maintain safety.

Removal for safety (no refund): If we refuse participation or remove you due to Sections 10.2–10.6 (safety non-compliance), the Ticket is treated as a late cancellation/no-show and is non-refundable, unless mandatory law requires otherwise.

Damage you cause: You are responsible for damage you cause intentionally or through negligent behavior (including to tools, property, or third parties), to the extent permitted by law.

Minor participants: Unless an Event page explicitly allows minors and states additional conditions, Events are intended for adults only.

Accidents and first aid: Basic first aid may be available, but you remain responsible for your own health and for obtaining any medical assistance you may require. If an incident occurs, you agree we may take reasonable steps to protect health and safety (including contacting emergency services).
10) Code of conduct
You must behave respectfully toward other attendees and staff. Harassment, discrimination, violence, or dangerous behavior is not tolerated and may lead to removal.
11) Intellectual property and materials
All Event materials and website content are owned by us or licensed to us. You may use materials for personal learning only. You may not copy, share, resell, publish, or record the Event/materials without our written permission.
12) Photos, video, and recordings

Attendee recordings: Audio/video recording by attendees is prohibited unless we explicitly permit it.

Our media: We may take photos/videos during Events for documentation/marketing. Where required, we will obtain consent or provide a reasonable opt-out as described in our Privacy Policy.
13) Newsletter

Opt-in: If you subscribe, you’ll receive newsletter emails with details of future events.

Unsubscribe: You can unsubscribe anytime via the link in any email.

Transactional emails: Booking confirmations and important Event updates are service messages and may still be sent even if you unsubscribe from our newsletter.
14) Privacy and data protection
We process personal data in accordance with the GDPR and our Privacy Policy. We use cookies/analytics as described in our Cookie Policy.
15) Prohibited use
You must not misuse the site (e.g., hacking, scraping, circumventing security, fraudulent bookings, chargeback fraud). We may cancel Tickets and/or suspend accounts where we reasonably suspect misuse.
16) Liability

No exclusion where unlawful: Nothing in these Terms excludes or limits our liability where such exclusion or limitation would be unlawful, including liability for harm to a person’s natural rights, harm caused intentionally, or by gross negligence, and any advance limitation of the weaker party’s right to compensation. Any such stipulation is disregarded under Czech law.

Your responsibilities and contributory fault: You must comply with the safety obligations in Section 10 and use reasonable care. To the extent permitted by law, if damage or injury is caused or increased by your own actions (e.g., ignoring instructions, unsafe handling of tools, inappropriate footwear/clothing, impairment), any compensation may be reduced accordingly.

Property and personal belongings: You attend Events at your own responsibility with respect to your personal belongings. We are not responsible for loss, theft, or damage to your personal items unless caused by our breach of legal duty.

Travel and third-party costs: We are not responsible for costs you choose to incur in connection with attending an Event (e.g., travel, accommodation, meals), except where mandatory law provides otherwise (for example, if an Event is cancelled by us and such costs must be reimbursed under applicable law).

Liability cap for non-personal losses: Subject to mandatory law and Section 17.1, our total liability for claims arising out of or in connection with an Event (other than harm to a person’s natural rights) is limited to the amount you paid for the relevant Ticket.

Indirect loss: Subject to mandatory law, we are not liable for indirect or consequential losses (e.g., loss of profit, loss of business opportunity).
17) Complaints, consumer rights, and out-of-court dispute resolution (ADR)

Contact first: If you have a complaint, please contact us at [support email] with your booking reference. We will try to resolve the matter amicably.

ADR (Consumers): If you are a consumer and a dispute cannot be resolved directly with us, you may submit a proposal for out-of-court settlement (ADR) to the Czech Trade Inspection Authority (Česká obchodní inspekce / CTIA).

EU ODR platform notice: The European Commission’s Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025, so we do not provide an ODR platform link in these Terms.
18) Governing law and jurisdiction

These Terms and any contract for Tickets are governed by the laws of the Czech Republic.

If you are a consumer, you may also benefit from mandatory consumer-protection rules of your country of residence within the EU (where applicable).

Any disputes may be brought before the competent courts in the Czech Republic, and (for consumers) also before other courts where mandatory EU consumer jurisdiction rules allow.
19) Changes to these Terms
We may update these Terms from time to time. The “Effective date” will change accordingly. If changes materially affect existing bookings, we will provide notice where required by law.
